TOPEKA — The American flag has never been more important in the fight for human rights or the environment. And that is why a Tompkins County judge has ordered it lowered Friday from its current spot.


For the last two days, the Confederate battle flag, flying above the courthouse at 509 State Road in Tompkins City, has been suspended as the Tompkins County Republican Party begins to petition the county's highest court to lower it.


And that's where the story begins.

The Tompkins County Republican party, the parent organization of Tompkins County GOP, is asking Tompkins County Judge Kevin Dickson to remove the battle flag from public view until the Supreme Court rules whether it's unconstitutional under the U.S. Constitution.


"The First Amendment applies both to public display and its display to the public at large," the Republican party's email to state GOP officials said. "It does not apply to the display of a personal battle flag for display of a state party's name to be included on a monument."


So, the party is trying to keep it there. But for its part, Tompkins County State Sen. Kevin McCall, D-Wesley Chapel, says it's an effort by a partisan group to stop the county from doing its job, which he says is to protect minority voters.


The Tompkins County Republican Party is now trying to get the flag reinstated for display on the grounds that the flag violates the United States Constitution.


"I'm just baffled by their notion that you can display a flag, fly it without wearing uniforms, without displaying it proudly, without having a plaque put in front of it, without anything that it's a symbol of a political party," McCall said.


He says the flag may even come down before the next meeting of the Tompkins County Republican Party.


"My position has never been that the county should have removed it," he said. "I just haven't been comfortable with their position of putting the flag up for that reason."


But some Tompkins County voters also are offended by the display, especially those who do not live in the county.


"It shouldn't be here, and I don't want people in my community to have to see it," said Susan Smith, who lives in the city of Tompkins.


Smith's husband is a Tompkins County judge.
